Aiken Man Arrested for Serious Domestic Violence Charges

In the city of Aiken, a local man recently found himself in hot water after allegedly committing a violent act against a woman. Stephen Michael Smith, a 40-year-old resident, was arrested on November 18, following a disturbing incident that occurred a few weeks earlier.

What Happened?

According to reports, the troubles began on October 25 when Smith returned to a home on Palm Drive. The woman in question stated that she was abruptly awakened when Smith began hitting her foot in what she described as an aggressive manner. His ire stemmed from her not responding to a text he had sent earlier, which leads us to wonder: couldn’t there have been a better way to express his frustration?

The woman told authorities that during the confrontation, she attempted to defend herself by kicking Smith, only to have him retaliate with a punch to her ribs before leaving the room. A juvenile female who witnessed the loud and heated interaction reported hearing a slapping sound right before Smith exited the room. This account highlights how domestic violence can echo through families, affecting those around them.

Officers Arrive on the Scene

After being notified, the Aiken Public Safety officers quickly tracked down Smith behind the residence. Officer B.O. Scott described the scene, noting that it was “very apparent” that Smith was under the influence of alcohol at the time of his arrest. His noticeable odor of alcohol, unsteady gait, and slurred speech painted a pretty clear picture of his state. Despite this, Smith waived his Miranda rights to talk to the officers and told his side of the story.

In his account, Smith claimed he had simply come home from a local bar and gave the woman a light tap on her leg to announce his arrival. He even insisted that it was she who kicked him in the face. However, Officer Scott noted that Smith showed no signs of injuries that would suggest he had been kicked, such as swelling or bruising.

The Serious Charges

Initially arrested for third-degree domestic violence, Smith’s situation escalated when the woman later provided a medical report. This report revealed that she had sustained serious injuries, including broken ribs and a collapsed lung. Given the severity of her situation, Smith now faces upgraded charges of first-degree domestic violence, which is a felony carrying a potential prison sentence of up to ten years.

Legal Proceedings

As proceedings move forward, Aiken County Magistrate Tracey Carroll set Smith’s bond at $20,000. Remarkably, he managed to post this bond the same day of his arrest and has since been released from the Aiken County detention center. For now, there are no further court dates scheduled, leaving the community to ponder the implications of such incidents on their safety and well-being.
